Recruitment without trade union delegation

You have an open vacancy and are looking for a temporary worker with the intention of offering them a permanent contract after the interim period.

You have no trade union delegation.


Maximum duration

The maximum duration per temporary worker is 6 months. Per vacancy, the total maximum duration within a period may not exceed 9 months. For the calculation of the 9 months, only the periods during which the temporary workers are under contract should be counted. At least weekly contracts must be provided for the temporary worker.


What steps do you need to take?

  • Employment guarantee during the first month of employment for candidates who have resigned from their permanent job to start as a temporary worker under the recruitment motive.
  • You may make a maximum of 3 attempts (i.e., placing a temporary worker on this vacancy three times).
  • You are not obliged to offer the temporary worker a permanent contract after the interim period. However, you must be able to justify this.
  • In the event of permanent recruitment after interim, a contract of indefinite duration must be concluded and the period as a temporary worker counts towards the accrual of seniority.
